When does the Welsh Government intend to limit the moratorium on forfeiture of commercial leases for non-payment of rent?
The mortarium contained in section 82(1) of the Coronavirus Act 2020 has ended.
The end of the temporary moratorium period contained in the Commercial Rent (Coronavirus) Act 2022 (“the 2022 Act”) depends on whether or not the matter of relief from payment of rent debt falling in scope of the protection of the 2022 Act was referred to the arbitration regime within six months, beginning on the day on which the 2022 Act was passed.
Generally speaking, if there was such a referral, then the moratorium period for the purposes of the 2022 Act ends when the arbitration concludes, but if there was no such referral, then then the moratorium period for the purposes of the 2022 Act has ended.
