Welcome to the Constitutional and Legislative Affairs Committee meeting on Monday 5 February 2018. Item 1: apologies or declarations of interest. There are no apologies. Any declarations of interest? I see there are none. The usual housekeeping rules will apply to this meeting. No fire alarm test is anticipated.

Item 2: instruments that raise no reporting issues under Standing Order 21.2 or 21.3. Negative resolution instruments: the Regulation and Inspection of Social Care (Wales) Act 2016 (Consequential Amendments to Secondary Legislation) Regulations 2018. Then the affirmative resolution instruments: the Regulation and Inspection of Social Care (Wales) Act 2016 (Consequential Amendments) Regulations 2018, and the Social Care Wales (Specification of Social Care Workers) (Registration) (Amendment) Regulations 2018. Any comments from the lawyers on these? No. Any comments from Members? No. Is everyone content?

3. Instruments that raise issues to be reported to the Assembly under Standing Order 21.2 or 21.3

In which case, we move on to item 3, instruments that raise issues to be reported to the Assembly under Standing Order 21.2 or 21.3. Composite affirmative resolution instruments: the Waste Enforcement (England and Wales) Regulations 2018. You have with you the regulations, explanatory memorandum and report. This instrument amends two Acts of Parliament to provide powers for regulators to tackle illegal activity in the waste sector, which includes sites permitted under the Environmental Permitting (England and Wales) Regulations 2016, or which are exempt from the requirement to have a permit. Can I invite the lawyers to make any comments?

There are two things noted in the draft report. These are composite regulations, meaning they are made by a Secretary of State and the Welsh Ministers and they're laid before both the Assembly and the Parliament, and they're only being made in English. The second point to note: again, this is another kind of EU-type instrument. It'll form part of EU-derived domestic legislation and will be retained as domestic law on and after exiting the European Union.

Just to repeat our plea to have these matters dealt with bilingually.

We have written, and I think we should write again. This is yet another example. There's no reason why they shouldn't have been made in Welsh. They are amending Welsh legislation. Can we do the same thing? We'll see what response we get to the substantive letter that we sent a little while ago.
